OFFICIAL RULES
NO PURCHASE NECESSARY
1. SWEEPSTAKES: The Hair Shop Giveaway (the “Sweepstakes”) begins at 12:00 PM (noon) Eastern Time (”ET”) on 10/6/25 and ends at 11:59 PM ET on 10/10/25 (the “Sweepstakes Entry Period”).
2. ELIGIBILITY: Open only to legal residents of the 50 United States and Washington, D.C. (“Territory”), who are 18 years of age or older at time of entry (“Entrant”). Void outside the Territory and where prohibited by law. Employees of Wella Operations US LLC (“Sponsor”), and its subsidiaries, advertising and promotion agencies (collectively, the “Promotion Entities”) and the immediate family members and/or those living in the same household of each are not eligible. Entrants must also have a valid email address and phone number, which may be used to fulfill the prizes (“Prizes”).
3. HERE’S HOW IT WORKS: During the Sweepstakes Entry Period, follow @thehairshopinc and @wellaeducation on Instagram and look for the Sweepstakes related post. Complete step (A) below to receive one (1) chance to win, then complete the optional step (B) if you would like to receive one (1) additional bonus chance to win.
Follow the instructions in the Sweepstakes related post to like the post and tag three (3) friends in the post comment section (your initial "Submission" or “Entry”).
(Optional) Share the Sweepstakes related post to your Instagram story (your bonus "Submission" or “Entry”).
Entrants must have a public (non-private) Instagram account. ENTRIES WILL NOT BE JUDGED. Limit one (1) Entry from Step (A) and one (1) Entry from Step (B) per person. A person may only enter using one Instagram account. Duplicate submissions will be disqualified. All Entries must be received by 11:59 PM ET on 10/10/25 to be eligible. All Entries must comply with the Submission Guidelines outlined in Rule #4.
SUBMISSION GUIDELINES: Entries must comply with Instagram Terms of Use. Determination of compliance with Submission Guidelines and these Official Rules will be in the sole discretion of the Sponsor, whose decisions are final.
Submission cannot contain any information that references other websites, addresses, email addresses, contact information or phone numbers.
The Submission must not contain derogatory statements (including words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation, or socioeconomic group).
The Submission must not include threats to any person, place, business, or group; it must not invade privacy or other rights of any person, firm, entity, and it must not in any way violate or promote violation of applicable federal, state, or local laws and regulations including, but not limited to, those concerning copyright, plagiarism, trademark, publicity/privacy rights and defamation.
Submission must not include or show any dangerous behavior or activity or contain content that promotes dangerous activities that may result in injury to oneself or others.
Submission must not contain indecent behavior, profanities or obscenities, including but not limited to nudity, or pornography, and must not in any way disparage persons or organizations, including those associated with Sponsor and the Promotion Entities.
Submission must not include any personally identifiable information of any third party.
Submission must not refer, depict or in any way reflect negatively upon the Sponsor, the Sweepstakes, or any other person or entity.
Submission must be suitable for presentation in a public forum and be consistent with the theme and image of the Sweepstakes.
Submission must not promote irresponsible or excessive consumption of alcohol, promote illegal drugs, tobacco, firearms/weapons, or any particular political agenda or message.
5. LIMITATIONS: Entrants who have not complied with these Official Rules are subject to disqualification and their Entries will be void. Sponsor reserves the right to disqualify any Entrant’s Entry in the Sweepstakes if Sponsor determines or suspects that the Entrant has attempted to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other fraudulent, deceptive, or unfair playing practices. Sponsor reserves the right to cancel, modify, or suspend the Sweepstakes at any time if fraud, technical failures, or any other errors or other causes corrupt the administration, security, integrity, or proper play of the Sweepstakes. In the event of cancellation, Sponsor reserves the right to select the winner from among all eligible Entries received up to the time of such cancellation, in a manner determined by Sponsor to be fair, appropriate, and consistent with these Official Rules.
The Promotion Entities do not warrant that access to the Sweepstakes will be uninterrupted. Neither the Promotion Entities, nor any of their officers, directors, shareholders, employees, agents or representatives (individually and collectively, “Releasees”) are responsible for: (a) Entries from persons residing, or physically located, outside the Territory; (b) Entries that are altered, delayed, deleted, destroyed, forged, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, irregular in any way, late, lost, misrouted, multiple, non-delivered, stolen, tampered with, unauthorized, unintelligible or otherwise not in compliance with these Official Rules; (c) lost, interrupted or unavailable networks, servers, satellites, websites, or other connection, availability, or accessibility problems arising in connection with or over the course of the Sweepstakes; (d) failure of personal computers and/or software and hardware configurations, any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other errors in connection with the administration of the Sweepstakes, the processing of Entries, or the offering or announcement of the Prizes or any Prize notification documents; (e) any other errors of any kind relating to or in connection with the Sweepstakes, whether human, mechanical, clerical, electronic, or technical in nature; (f) the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Sweepstakes; (g) any changes to any website function that may interfere with the Sweepstakes or their ability to timely enter; or (h) damage to a user's system occasioned by participation in this Sweepstakes or downloading any information necessary to participate in this Sweepstakes; even if caused by the negligence of any of the Releasees.
6. PRIZES AND APPROXIMATE RETAIL VALUE (“ARV”): (1) Grand Prize – An XL Ultimate Repair Miracle Hair Spray, the Ultimate Smooth product line (Shampoo, Conditioner, Mask & Miracle Hair Oil), NEW Surreal Color Trend Collection Shades (2 Shinefinity, 2 Color Touch, 2 Koleston Perfect and 4 travel-size developers) and Smart Weft HIEWS x Daniel Mora Extensions from @thehairshopinc, winner to select their choice of color from among available colors, a Smart Weft HIEWS 22-inch Hair Extensions, an XL MHR, a full size Ultimate Smooth OIL, an Ultimate Smooth shampoo, an Ultimate Smooth Conditioner and an Ultimate Smooth Mask, a color collection consisting of a Shinefinity 07/39 Chroma Gold, a Shinefinity 09/39 Iridescent Gold, a CT 5/19 Light Brown/Ash Cendre, a CT 7/19 Medium Blonde/Ash Cendre, a KP 6/98 Dark Blonde/Cendre Pearl, a KP 8/98 Light Blonde/Cendre Pearl, a WP SH BASE 60ml 2% Bottle, a WP SH BASE 60ml 2% Bottle, a WELLOXON Perf 20V 6,0% 60ml, and a WELLOXON Perf 20V 6,0% 60ml (ARV: $2,520). No substitution or transfer of Prize by winner permitted. Sponsor reserves the right to substitute a Prize of equal or greater value, in their sole discretion. Winner will be responsible for all federal, state and local income taxes.
7. RANDOM DRAWING AND ODDS OF WINNING: The winner will be selected in a random drawing to be conducted on or about 10/13/25 from among all eligible Entries received. The drawing will be conducted by Sponsor, whose decisions are final on all matters relating to the Sweepstakes. Odds of winning depend on the total number of eligible Entries received.
8. WINNER NOTIFICATION: The potential winner will be contacted regarding fulfillment of their Prize via Direct Message (“DM”) from @thehairshopinc or @wellaeducation on Instagram beginning on or about 10/14/25. The potential winner must reply with the information requested in the DM within 48 hours from the time their notification was sent. Noncompliance with this deadline may result in disqualification and the selection of an alternate potential winner. Potential winner will then be required to electronically sign and return a Declaration of Eligibility, Liability/Publicity Release (except where prohibited by law) (“Declaration Package”) within five (5) days of notification attempt or potential winner may be disqualified and an alternate potential winner may be randomly selected. Return of Declaration Package as undeliverable, if Declaration Package is not received within the required time period, or if a potential winner is deemed ineligible, said winner will be disqualified and an alternate will be selected. Sponsor assumes no responsibility for undeliverable DMs or emails resulting from any form of active or passive filtering by email service providers or for insufficient space in user’s account to receive email. Return of any DM, email, or Prize as undeliverable will result in disqualification and an alternate potential winner will be selected.
9. DISPUTES; GOVERNING LAW: The parties (“Entrant and Sponsor”) waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Sweepstakes. Any controversy or claim arising out of or relating to these Official Rules and/or the Sweepstakes shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of California, City of Los Angeles.
THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF CALIFORNIA WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. For any matters which are not subject to arbitration as set forth in these Official Rules and/or in connection with the entering of any judgment on an arbitration award in connection with these Official Rules and/or the Sweepstakes, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to Los Angeles County in the State of California. The parties agree not to raise the defense of forum non conveniens.
10. USE OF DATA: Sponsor will be collecting personal data about Entrants online, in accordance with their privacy policy. Please review the privacy policy at https://www.wellacompany.com/privacy-policy. By participating in the Sweepstakes, Entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted the privacy policy. In addition, anyone who opts in to receive marketing emails from Sponsor will be added to Sponsor’s marketing list. Users can unsubscribe from emails from Wella Brands at any time using the unsubscribe links in marketing emails or by visiting: https://www.wellacompany.com/consumer-affairs.
11. RELEASES: By participating in this Sweepstakes, you agree: (a) to release, indemnify, and hold harmless the Promotion Entities from any and all liability, loss, or damage incurred with respect to participating in the Sweepstakes or the awarding, receipt, possession, and/or use or misuse of a Prize including without limitation any claims for property damage, personal injury, illness and/or death, and any claims in the nature of infringement of intellectual property, privacy or publicity rights; (b) that under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, any punitive, indirect, incidental, consequential, exemplary, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Sweepstakes or any awarded Prize shall be resolved individually, without resort to any form of class action; (d) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, and in no event will you be entitled to receive attorneys’ fees or court costs. Winner, by acceptance of a Prize, grant to Sponsor, the other Promotion Entities, and each of their respective designees the absolute right and license to use, publish, post, and/or display his/her/their name, address (city and state of residence), photograph, voice, likeness, and/or other indicia of persona (regardless of whether altered, changed, modified, edited, used alone, or used with other material in the Promotion Entities’ sole discretion) in any and all media now known or hereafter devised, throughout the world, in perpetuity, without additional compensation or consideration, notification or permission, unless prohibited by law.
12. GENERAL: The Promotion Entities’ failure to or decision not to enforce any provision in these Official Rules will not constitute a waiver of that or any other provision. In the event of any conflict with these Official Rules and Sweepstakes-related materials, these Official Rules shall prevail. In no event shall more than the stated number of Prizes in these Official Rules be awarded. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. The Promotion Entities’ employees are not authorized to waive, modify, or amend any provision or provisions of these Official Rules in any manner whatsoever. ANY ATTEMPT BY AN ENTRANT OR OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL, TO THE FULLEST EXTENT PERMITTED BY LAW.
13. WINNER LIST: The name of the winner will be posted by the @wellaeducation and/or @thehairshopinc via Instagram Stories after the Prize has been awarded.
The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Instagram. You understand you are providing your information to Sponsor and not Instagram.
